Release & Waiver of Liability Of Golf Almighty

In consideration of entering the facilities and participating in activities at GOLF ALMIGHTY (including its subsidiaries and related corporations, applying to all locations operated by GOLF ALMIGHTY or its subsidiaries), I agree to this Release and Waiver of Liability. This includes the use of all facilities, such as parking lots, entrances, buildings, simulator bays, walkways, hallways, offices, and the rental and use of all equipment (hereinafter referred to as “Facilities and Equipment”).

In consideration of my desire to participate in activities at the premises, I acknowledge the associated risks, including but not limited to injury by golf equipment, overexertion, exposure to viruses, including COVID, or any other foreseeable or unforeseeable risks.

I, for myself and on behalf of others I permit to use the facilities, enter into this Waiver and Release of Liability, waiving any and all rights, claims, or causes of action arising from my participation in the activity.

I release GOLF ALMIGHTY, its affiliates, managers, members, agents, staff, and others (collectively referred to as “Releasees”) from any injury suffered due to my participation in the activity, including negligence or breach of contract, duty of care, or any other fiduciary duties.

I voluntarily participate in the activity at my own risk, fully aware of potential outcomes such as physical or psychological injury, illness, economic loss, or death, arising from my own or others’ negligence.

I agree to indemnify the Releasees against any claims, suits, or actions for liability, damages, or compensation brought by me or on my behalf.

I acknowledge and assume all risks, whether foreseen or unforeseen, and understand that the Releasees are not responsible for errors, omissions, acts, or negligence by any party at the Facilities.

I understand that alcohol consumption is strictly prohibited at the Facilities, and Releasees are not liable for any breach of this condition.

Notwithstanding anything to the contrary, Releasees’ total liability is limited to amounts paid for the use of Facilities and Equipment.

I acknowledge that the Activity requires physical ability and competency, assuming all risks involved.

This Release is governed by the laws of the Province of Ontario, and I waive my legal rights against the Releasees.

I have read and fully waive my legal rights against the Releasees, indemnifying them regarding my use of Facilities and Equipment.

My registration with GOLF ALMIGHTY constitutes consent and agreement with these terms.
